The IRS and states work differently when collecting income tax debt. The IRS will send multiple notices, providing 30 days’ notice in between each notice. Once you receive a Final Notice of Intent to Levy is when the collection process will begin. The states, however, do not always send you a written notice. Some do, and some don’t. They also act much swifter utilizing third party collection agencies, placing holds on your state issued license(s), perform bank levies and wage garnishments. The state taxing authorities tend to be more aggressive in the collections process than the IRS. It is important that you work on resolving your taxes immediately before collection activity takes place. It is recommended to work with tax relief specialists like Advocate Tax Solutions.

Often times taxpayers misplace or lose their tax information over the years. For all previous years other than the current filing year we will be able to access your last 10 years of wage and income and account transcripts. We will also be able to retrieve your state withholdings if necessary. Below is a list of common forms we collect to prepare your returns and make things easier for you.
- Expense Worksheet
- Prior year tax returns if amending a return
- Name(s), social security number(s), date of birth(s) of any dependents
Tax Settlement
A tax settlement is an arrangement made with the IRS and or state taxing authority that allows the taxpayer to settle their tax debt for less than the amount owed. The state only offers one option, an Offer in Compromise. Maryland is the only state that does not offer this program. The IRS has two settlements available. One is an Offer in Compromise and the other is a Partial Payment Installment Agreement. All settlement agreements are subject to approval by the IRS and state taxing authorities.
A tax settlement allows taxpayer’s tax debt to be settled for less than what is owed.
To qualify for a settlement the IRS and the state will verify your current income, expenses, and assets. If you are cash flow negative on a monthly basis and have less assets than what is owed, you may qualify. These forms and processes are very challenging and why it is important to hire an experienced firm like Advocate Tax Solutions. Typically, taxpayers facing financial hardship are more likely to qualify for a settlement
The IRS and state taxing authorities ultimately make the final decision so there is no guarantee that your settlement will be accepted. However, working with a tax relief professional only increases your chances for a more favorable outcome.
